DOJ sues Uber over 'wait time' fees

The Department of Justice has filed suit against Uber over the company's practice of charging fees when drivers have to wait more than two minutes for a passenger to get in their vehicle.

Uber began violating the Americans with Disabilities Act in 2016 when it first began charging these fees in target markets, the Justice Department said in a statement. Those fees are now being charged across the country, it said.

Uber charges wait time fees to all riders who take extra time to get into a vehicle, after two minutes for UberX and after five minutes for Uber Black and SUV. Some Uber options, including wheelchair-accessible trips and Uber Assist, don't have any wait time fees by default, but those options aren't available in all locations.

"Passengers with disabilities who need additional boarding time are entitled to access ridesharing services without discrimination," Stephanie Hinds, acting US attorney for the Northern District of California, said in a release. "This lawsuit seeks to assist people with disabilities to live their lives with independence and dignity, as the ADA guarantees."

In response, Uber said in a statement, "We fundamentally disagree that our policies violate the ADA."

The company said it had already been in discussions with the Justice Department about how to rectify the wait fees situation "before this surprising and disappointing lawsuit" was filed in the Northern District of California.
